Il y a 2 possibilit\u00e9s:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-71a286b elementor-widget elementor-widget-heading\" data-id=\"71a286b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">1) Licenciement moyennant une indemnit\u00e9 de pr\u00e9avis<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-25df67f elementor-widget elementor-widget-text-editor\" data-id=\"25df67f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La valeur du reclassement professionnel (60 heures) correspond \u00e0 1\/12 du salaire annuel brut de l\u2019employ\u00e9 de l\u2019ann\u00e9e civile pr\u00e9c\u00e9dant son licenciement. Dans ce cas-ci, vous pouvez retenir 4 semaines de salaire pour financer le reclassement professionnel.  Ce trajet comporte les 3 phases suivantes:<\/p>\n<p>1. 20h pendant max. 2 mois<br>2. 20h pendant max. 4 mois<br>3. 20h pendant max. 6 mois<\/p>\n<p>Vous devez faire au collaborateur une offre \u00e9crite de reclassement professionnel dans les 15 jours suivant la fin du contrat de travail. Le collaborateur dispose alors d\u2019un mois pour faire savoir par \u00e9crit s\u2019il accepte l\u2019offre. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0bece1c elementor-widget elementor-widget-heading\" data-id=\"0bece1c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2) Licenciement moyennant un d\u00e9lai de pr\u00e9avis<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3cd01d4 elementor-widget elementor-widget-text-editor\" data-id=\"3cd01d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>L\u2019accompagnement de reclassement professionnel couvre 60 heures. Le temps consacr\u00e9 \u00e0 cet accompagnement est imput\u00e9 sur le cong\u00e9 de sollicitation du collaborateur.<\/p><p><span style=\"font-size: 16px; color: var( --e-global-color-text );\">Vous devez faire au collaborateur une offre \u00e9crite dans les 4 semaines suivant l\u2019annonce du licenciement. Le collaborateur dispose alors de 4 semaines pour faire savoir par \u00e9crit s\u2019il accepte l\u2019offre. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d5be8bf elementor-widget elementor-widget-heading\" data-id=\"d5be8bf\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"opzeg-2\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Licenciement \u2013 pr\u00e9avis 45 ans | Le reclassement professionnel conforme au r\u00e9gime sp\u00e9cifique (CCT 82 bis)<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-60331e3 elementor-widget elementor-widget-text-editor\" data-id=\"60331e3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si vous \u00eates un employeur du secteur priv\u00e9, vous \u00eates l\u00e9galement oblig\u00e9s de faire une offre \u00e9crite de reclassement professionnel lorsque vous licenciez un travailleur qui:  <\/p><ul><li>poss\u00e8de au moins 1 an d\u2019anciennet\u00e9 ininterrompue<\/li><li>a 45 ans ou plus<\/li><li>n\u2019est pas licenci\u00e9 pour motif grave<\/li><\/ul><p>Vous devez faire au collaborateur une offre \u00e9crite de reclassement professionnel apr\u00e8s le licenciement et au plus tard 15 jours apr\u00e8s la fin du contrat de travail. Le collaborateur dispose alors d\u2019un mois pour faire savoir par \u00e9crit s\u2019il accepte l\u2019offre.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e798656 elementor-widget elementor-widget-heading\" data-id=\"e798656\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Vous ne devez pas proposer de reclassement professionnel:<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-52dfcf3 elementor-widget elementor-widget-text-editor\" data-id=\"52dfcf3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>aux collaborateurs qui travaillent moins qu\u2019\u00e0 mi-temps, sauf si le collaborateur demande explicitement le reclassement professionnel;<\/li><li>aux collaborateurs qui ne doivent plus \u00eatre disponibles pour le march\u00e9 du travail apr\u00e8s la p\u00e9riode couverte par leur indemnit\u00e9 de pr\u00e9avis ;<\/li><li>en cas de motif grave ;<\/li><li>en cas de rupture du contrat de travail de commun accord;<\/li><li>si le collaborateur atteint \u00e0 la fin de la p\u00e9riode de pr\u00e9avis <strong>62 ans ou s\u2019il a un <\/strong><strong>pass\u00e9 professionnel de 42 ans<\/strong>, sauf si ce collaborateur demande explicitement le reclassement professionnel.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8000fd0 elementor-widget elementor-widget-heading\" data-id=\"8000fd0\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"medisch\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Le reclassement professionnel pour force majeure m\u00e9dicale<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-70fb5c0 elementor-widget elementor-widget-text-editor\" data-id=\"70fb5c0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Depuis le <strong>1er avril 2024<\/strong>, l\u2019obligation d\u2019offrir un accompagnement outplacement lors d\u2019une rupture de contrat pour cause de force majeure m\u00e9dicale n\u2019est plus d\u2019application.<br>Dor\u00e9navant, l\u2019employeur doit, dans les 45 jours calendriers : <\/p><p>1. notifier la fin du contrat au Fonds Retour au Travail de l\u2019INAMI, et<br>2. verser une contribution de 1.800 \u20ac \u00e0 ce fonds.<br>Les travailleurs dont le contrat prend fin pour cause de force majeure m\u00e9dicale peuvent s\u2019adresser directement au Fonds Retour au Travail pour b\u00e9n\u00e9ficier d\u2019un accompagnement professionnel via des prestataires agr\u00e9\u00e9s. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-be8fac0 elementor-widget elementor-widget-heading\" data-id=\"be8fac0\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"vrijwillig\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">L\u2019offre volontaire<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f61b058 elementor-widget elementor-widget-text-editor\" data-id=\"f61b058\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>M\u00eame quand il n\u2019y a pas une obligation l\u00e9gale, vous pouvez en tant qu\u2019employeur, toujours faire une offre volontaire de reclassement professionnel.
